A tragic accident occurred north of Dallas yesterday in Fairview, where a worker was killed and another is missing after repairing a sewer line. Authorities say one of the men went into the sewer to remove a plug on a sewer line. The man was most likely overcome by gas from the sewer. When the man didn’t emerge, a second man went to find him and didn’t come out.

The body of the first man to go into the sewer was found yesterday morning. Authorities are looking for the second man but are not hopeful of finding him alive. It is standard procedure to check air quality before going into a sewer, but because the men were basically done with the project when they realize they had one line to unplug, they might have failed to follow safety recommendations. OSHA is currently investigating the accident.

If you have been injured in an accident at the workplace, you or your loved ones may be able to either collect workers’ compensation payment or other compensation for your injuries. Call Dallas workers’ compensation attorney Kris Barber at 972-231-5800 to learn more.

A worker at the Texas Instruments chip fabrication unit in Dallas was tragically killed last week after a water purifier explosion. The explosion caused flying glass to impale the victim. The accident remains under investigation.

In general, when an employee is injured or killed on the job, such as occurred in this tragic accident, the worker or the worker’s family (if the worker is killed) is entitled to workers’ compensation. This compensation is provided in exchange for the employee forfeiting his right to sue the employee for negligence. Most employers are required to carry workers’ compensation insurance for their employees. Workers’ compensation is administered on a state by state basis. In Texas, this program is called the Texas Workers’ Compensation System.

Usually, employees who are injured at work and make a workers’ compensation claim can receive wages, payment of medical expenses, and compensation for future economic loss. If a worker is killed in the course of employment, workers’ compensation benefits are available to dependents. Usually, compensation for pain and suffering or punitive damages against employers is not available under workers’ compensation programs.

If you have been injured in an on-the-job accident in the Dallas area, you should contact an experienced workers’ comp attorney as soon as possible. The workers’ comp insurance provider may refuse to pay in a timely fashion or to pay at all. Contact Dallas work accident attorney Kris Barber at 817-329-5095 to discuss pursuing your legal claim.

A tragic accident occurred May 19 at a cement plant about 25 miles southwest of Dallas. Five workers were burned at the plant. Three of those workers suffered critical injuries. Details on how the accident occurred are still not clear, but the burns occurred while a group of both contract workers and plant employees were doing maintenance work on a kiln in the plant. The three most critically injured workers were airlifted to a Dallas hospital. The others were transported by ambulance to a local hospital. The plant will remain shut down while the company investigates what happened.

The workers that were injured in the accident will have a claim for benefits. Workers who are injured on the job, either from a work accident or from repetitive motion over a long period of time, may be entitled to Workers’ Compensation. Workers’ Compensation can provide compensation for medical expenses, lost wages, and more. In some cases however, an injured employee may be able to pursue a claim directly against the company. This can occur if the company denied benefits or if the company did not subscribe to the Workers’ Compensation program.

Have you been injured in a job-related accident? If so, contact Dallas work accident attorney Kris Barber of the Barber Law Firm at 817-329-5095. You should contact an attorney as soon as possible after the accident, because a lawsuit must be filed within a certain amount of time after the injury.
